في ظل ما تشهده منطقة قضاء تلكيف من إجراءات تمسّ حقوق السكان الأصليين وتهدد خصوصيتها التاريخية والقومية، تصدر القوى السياسية لشعبنا الكلداني السرياني الآشوري هذا البيان لتأكيد موقفها الرافض لأي مشاريع تؤدي إلى تغيير الواقع الديموغرافي وفرض الأمر الواقع.

“بيان رفض واستنكار”
نعبر عن رفضنا الشديد واستنكارنا البالغ للإجراءات الجارية المتعلقة بإعادة تفعيل مشروع توزيع أراضي مجمع موظفي مؤسسة جابر بن حيان، وكذلك قرارات تمليك العشوائيات في منطقة القوسيات التابعة لقضاء تلكيف، لما تمثله هذه الخطوات من تهديد خطير للوجود التاريخي لشعبنا الكلداني السرياني الآشوري، ومحاولة واضحة لفرض واقع ديموغرافي جديد يتعارض مع الدستور والقانون والعدالة.
إن مشروع توزيع الأراضي ( ١٦٠٠ ) قطعة في مقاطعة (٢) قبر مريم يستند أساساً إلى قرارات صادرة عن مجلس قيادة الثورة عامي ١٩٩٢ و١٩٩٣ المنحل خلال سنوات النظام الدكتاتوري البائد، والتي هدفت إلى إحداث تغيير ديموغرافي في الواقع السكاني لمناطق شعبنا من خلال إطفاء الأراضي الزراعية لاهالي تلكيف. وبعد عام ٢٠٠٣، جاء قرار مجلس الحكم رقم (٥٠) الصادر في جلسته بتاريخ ٢٩ ايار ٢٠٠٣ ليبطل ويلغي كافة القوانين والقرارات والأوامر والتعليمات الصادرة عن مجلس قيادة الثورة والجهات الرسمية الأخرى التابعة للنظام الدكتاتوري البائد، والتي صدرت لغرض تغيير الواقع السكاني والديموغرافي والسياسي في العراق.
كما نص الدستور العراقي في المادة (٢٣/ثالثاً/ب) بشكل واضح على أنه: “يحظر التملك لأغراض التغيير السكاني”، إضافة إلى كتاب الأمانة العامة لمجلس الوزراء المرقم ق / ٦ / ١ / ١٥٧٥ والمؤرخ في ٢٢ شباط ٢٠٠٣، الذي منع دوائر الدولة كافة من تسجيل قطع الأراضي الموزعة وفق قرارات مرتبطة بتغيير الواقع القومي والديموغرافي في مناطق العراق.
وعليه، فإن إعادة العمل حالياً بمشروع أراضي جابر بن حيان، وقيام الجهات المعنية بالمباشرة بإجراءات التسوية وفتح الشوارع وتثبيت البلوكات السكنية، يمثل خرقاً واضحاً للدستور العراقي وللقرارات الرسمية النافذة، واستخفافاً بحقوق أصحاب الأراضي الأصليين وبالخصوصية التاريخية والقومية لشعبنا الكلداني السرياني الآشوري في بلداته التاريخية.
كما أن الاستمرار بتمليك آلاف الوحدات العشوائية المقامة على أراضي أبناء تلكيف الزراعية في منطقة القوسيات ( ٦٠٠٠ ) ستة ألاف وحدة سكنية عشوائية، يمثل تكريساً لسياسة فرض الأمر الواقع ومكافأة للتجاوزات على حساب السكان الأصليين وحقوقهم التاريخية والقانونية، الأمر الذي يندرج ضمن سياسات التغيير الديموغرافي المرفوضة قانونياً ووطنياً وأخلاقياً.
إن ما يجري اليوم في تلكيف لا يمكن فصله عن مسلسل التغيير الديموغرافي الذي تعرضت له مناطق سهل نينوى على مدى السنوات الماضية، والذي يستهدف تقليص الوجود القومي لشعبنا الكلداني السرياني الآشوري عبر إجراءات ومشاريع تتعارض مع الدستور والقانون وروح الشراكة الوطنية.
وعليه، فإننا نطالب بما يلي:
* الإيقاف الفوري لجميع الإجراءات المتعلقة بمشروع أراضي جابر بن حيان.
* تجميد قرارات تمليك العشوائيات في منطقة القوسيات لحين معالجة الملف وفق القانون وبما يحفظ حقوق أصحاب الأراضي الأصليين.
* الالتزام الكامل بقرار مجلس الحكم رقم (٥٠) القاضي بإلغاء كل قرارات مجلس قيادة الثورة المتعلقة بالتغيير السكاني والديموغرافي.
* فتح تحقيق رسمي بشأن الجهات التي تسعى لإعادة تفعيل قرارات ملغاة ومخالفة للدستور.
* حماية الخصوصية القومية والتاريخية لبلدات سهل نينوى ومنع أي سياسات أو مشاريع تؤدي إلى تغيير هويتها السكانية.
* احترام حقوق الملكية الخاصة وتعويض المتضررين وفق الأطر القانونية العادلة.
إننا نحذر من خطورة الاستمرار بهذه السياسات التي تهدد السلم المجتمعي والتنوع التاريخي في المنطقة، ونؤكد أن أبناء شعبنا لن يقفوا صامتين أمام أي محاولة للمساس بأرضهم ووجودهم وحقوقهم المشروعة، وإننا ندعو إلى مظاهرات في مناطقنا المختلفة، سيتم الإعلان عن موعدها ومكانها قريباً.
المجد لشعبنا الصامد والخزي والعار لكل مشاريع التغيير الديموغرافي والتجاوز على الحقوق التاريخية.

Statement of Rejection and Condemnation
We express our strong rejection and deep condemnation of the ongoing measures related to the reactivation of the land distribution project of the Jaber Bin Hayyan Foundation Employees Complex, as well as the decisions to legalize and grant ownership of informal settlements in the Al-Qawsiyat area of Tel Keppe District. These steps constitute a serious threat to the historical presence of our Chaldean Syriac Assyrian people and represent a clear attempt to impose a new demographic reality that contradicts the constitution, the law, and the principles of justice.
The land distribution project involving 1,600 plots in District (2) — Qabr Maryam — is fundamentally based on decisions issued by the dissolved Revolutionary Command Council in 1992 and 1993 during the former dictatorial regime. Those decisions aimed to alter the demographic composition of our people’s areas through the confiscation and extinguishing of agricultural lands belonging to the people of Tel Keppe. Following 2003, Governing Council Decision No. (50), issued during its session on 29 May 2003, annulled and invalidated all laws, decisions, orders, and instructions issued by the Revolutionary Command Council and other official bodies affiliated with the former dictatorial regime that were intended to change the population, demographic, and political reality in Iraq.
Furthermore, Article (23/Third/B) of the Iraqi Constitution clearly states: “Ownership for the purposes of demographic change is prohibited.” In addition, the letter issued by the General Secretariat of the Council of Ministers, No. Q/6/1/1575 dated 22 February 2003, prohibited all state institutions from registering plots of land distributed under decisions linked to altering the ethnic and demographic reality in Iraqi regions.
Accordingly, the current reactivation of the Jaber Bin Hayyan land project, and the commencement by the concerned authorities of settlement procedures, road openings, and the designation of residential blocks, constitute a clear violation of the Iraqi Constitution and effective official decisions, as well as a disregard for the rights of the original landowners and the historical and national identity of our Chaldean Syriac Assyrian people in their historic towns.
Likewise, the continued legalization of thousands of informal housing units built on the agricultural lands of the people of Tel Keppe in the Al-Qawsiyat area — amounting to 6,000 informal housing units — represents a consolidation of the policy of imposing a fait accompli and rewarding violations at the expense of the indigenous population and their historical and legal rights. This falls within policies of demographic change that are legally, nationally, and morally unacceptable.
What is taking place today in Tel Keppe cannot be separated from the ongoing process of demographic change that the Nineveh Plain areas have experienced over the past years, targeting the reduction of the national presence of our Chaldean Syriac Assyrian people through measures and projects that contradict the constitution, the law, and the spirit of national partnership.
Accordingly, we demand the following:
* The immediate suspension of all procedures related to the Jaber Bin Hayyan land project.
* The freezing of decisions to legalize informal settlements in the Al-Qawsiyat area until the matter is resolved according to the law and in a manner that preserves the rights of the original landowners.
* Full adherence to Governing Council Decision No. (50), which annulled all Revolutionary Command Council decisions related to demographic and population change.
* The opening of an official investigation into the parties seeking to reactivate unconstitutional and annulled decisions.
* The protection of the historical and national identity of the towns of the Nineveh Plain and the prevention of any policies or projects aimed at altering their demographic character.
* Respect for private property rights and fair compensation for those affected within legal frameworks.
We warn against the dangers of continuing these policies, which threaten social peace and the historical diversity of the region. We affirm that our people will not remain silent in the face of any attempt to undermine their land, existence, and legitimate rights. We also call for demonstrations in our various regions, the date and location of which will be announced soon.
Glory to our steadfast people,
And shame and disgrace upon all projects of demographic change and violations against historical rights.
